Terms of Use

Introduction

These Terms of Use ("Terms") govern your access to and use of SOP Creator by Abscribe ("we," "our," "us"). By using our platform, you agree to these Terms.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of unauthorized access to your account.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate information when creating your account.

Service Description

SOP Creator is a software-as-a-service (SaaS) platform that converts screen recording videos into Standard Operating Procedures (SOPs) using artificial intelligence. Features include:

  • Video upload and AI-powered analysis
  • Automatic step extraction and screenshot generation
  • SOP editing, customization, and export
  • Public sharing and publishing options
  • Team workspaces with roles for owners, admins, editors, and viewers

Team Workspaces

  • Every account has a workspace. The person who owns a workspace is its owner.
  • The owner's plan determines the limits and features available to everyone working in that workspace.
  • SOPs created in a workspace count toward the owner's plan allowance, regardless of which member created them, and belong to that workspace.
  • Workspace members can view and work with the workspace's SOPs according to their role.
  • The owner and admins can invite and remove members. If a member is removed or leaves, the SOPs they created remain in the workspace.
  • Owners are responsible for who they invite and for their members' use of the service within the workspace.

Subscription Plans

We offer the following plans:

  • Free: Access to core features with a limited lifetime allowance of SOPs and limits on video length, file size, and features, as shown on our pricing page.
  • Pro: A paid subscription, billed monthly or annually, with a monthly SOP allowance, higher limits, and additional features such as export, copying content, removal of our branding from published pages, and team invites, as shown on our pricing page.
  • Plan Limits: Monthly SOP allowances reset at the start of each billing month, including on annual plans. Unused SOPs do not roll over.
  • Pricing Changes: We may adjust pricing or plan features with prior notice. Price changes will not affect current subscribers until their next billing cycle.

Payments

Payments are processed by Lemon Squeezy, which acts as our merchant of record. Lemon Squeezy handles payment processing, invoicing, and applicable sales taxes, and its terms apply to your purchase. We do not receive or store your full payment card details.

Billing and Cancellation

  • Auto-Renewal: All subscriptions auto-renew at the end of each billing cycle unless canceled.
  • Cancellation: You can cancel your subscription at any time via your account settings. Upon cancellation, the subscription will remain active until the end of the current billing cycle, after which it will not renew.
  • Failure to Cancel: If you do not cancel before the renewal date, your payment method will be charged for the next billing cycle.
  • Downgrading: When a paid plan ends, your workspace moves to the Free plan. Your SOPs remain in your account, but features and limits that require a paid plan are no longer available.

Refund Policy

  • Non-Refundable: All subscription purchases are non-refundable. This includes partial billing periods; we do not offer prorated refunds for unused time or features.
  • Cancellation: Subscriptions remain active until the end of the current billing cycle after cancellation. No refunds will be issued for unused time.
  • Immediate Termination: If you delete your account or your account is suspended due to violation of any terms, all active subscriptions will terminate immediately, and no refunds will be provided for the remaining period.
  • Billing Issues: In case of billing errors or other extraordinary circumstances, please contact our support team at jainam.shahd@gmail.com to request an evaluation of your case.
  • Your Statutory Rights: Nothing in these Terms limits any right to a refund that you have under the consumer protection laws that apply to you.

User Content

  • You retain ownership of all content you upload and SOPs you generate.
  • You grant us a limited license to process, store, and display your content solely to provide the service.
  • You are responsible for ensuring you have the right to upload any content.
  • You must not upload prohibited content, including but not limited to:
    • Content that infringes on intellectual property rights
    • Illegal content or content promoting illegal activities
    • Malware or malicious code
    • Content that violates the privacy of others

We do not monitor or review user content but reserve the right to remove content or suspend accounts violating these Terms.

Acceptable Use

You agree not to:

  • Use the service to process content containing sensitive personal information (PII) or protected health information (PHI) without appropriate safeguards
  • Reverse engineer, decompile, or attempt to extract the source code of our platform
  • Use the service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the service or servers connected to the service
  • Use automated systems (bots, scrapers) without our written permission
  • Exceed usage limits or circumvent plan limits or rate limiting measures

Intellectual Property

  • The SOP Creator platform, including its design, features, and technology, is owned by Abscribe and protected by intellectual property laws.
  • You may not copy, modify, or distribute our platform without permission.
  • Your use of the service does not grant you any ownership rights in our intellectual property.

AI-Generated Content

  • SOPs are generated using artificial intelligence and may contain errors or inaccuracies.
  • You are responsible for reviewing and verifying all generated content before use.
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
  • You should not rely on AI-generated SOPs for critical safety, medical, legal, or regulatory purposes without human review.

Features and Bugs

Our platform is designed to deliver the best experience based on user feedback and ongoing development. While we strive to meet diverse user needs, we do not guarantee that our Services will always align with every specific expectation or requirement.

While we test all new features thoroughly before release, we acknowledge that software may have bugs. We work diligently to address issues, particularly those related to security, privacy, or functionality. However, we do not guarantee that all reported issues will be resolved immediately, nor can we promise that the Services will be free of errors at all times.

Service Availability

  • We strive to provide continuous service but may experience downtime for maintenance or unforeseen issues.
  • Scheduled maintenance will be communicated in advance when possible.
  • We do not guarantee any specific uptime percentage.

Data Retention and Deletion

  • Uploaded videos are retained until you delete your SOP.
  • You can delete your SOPs at any time through the application, subject to your role in the workspace.
  • When you delete your account, your content is taken offline immediately and permanently deleted within 30 days, as described in our Privacy Policy. Deleting your account also cancels any active subscription, without a refund.

Termination

  • You may terminate your account at any time through your account settings.
  • We may suspend or terminate your access if you violate these Terms.
  • Upon termination, your right to use the service ceases immediately.
  • Provisions that by their nature should survive termination will survive.

Limitation of Liability

SOP Creator is provided "AS IS," without warranties of any kind, whether express or implied, regarding the platform's functionality, performance, or results. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You understand and agree that Abscribe shall not be responsible, under any circumstances, for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, business, goodwill, data, or other intangible assets, even if we were made aware of the potential for such damages. This includes damages resulting from:

i. your use or inability to use our Services; ii. the cost of acquiring substitute products or services; iii. unauthorized access to or modification of your data or transmissions; iv. errors or inaccuracies in AI-generated content; v. any third-party actions or conduct within the platform; vi. or any other situation linked to these Terms or the Services.

This limitation of liability applies as broadly as allowed by applicable law and survives the termination of these Terms.

Indemnification

You agree to indemnify and hold harmless Abscribe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms.
